LINCOLNSHIRE POLICE AUTHORITY INDEPENDENT CUSTODY VISITING SCHEME - MEMORANDUM OF UNDERSTANDING


I ________________________________________________________ (full name)

  1. as an accredited member of the Lincolnshire Police Authority Independent Custody Visiting Scheme, do undertake to

    1. Maintain high standards of personal conduct, integrity and appearance;

    2. arrange custody visits with fellow custody visitors, in line with agreed rosters;

    3. keep the co-ordinator and fellow custody visitors informed of any problems with rostered custody visits;

    4. carry out custody visits to designated police stations in line with the Scheme guidelines and training;

    5. undertake late night visits to designated police stations where indicated on the visiting programme;

    6. check on the conditions in which a detainee is kept, their health and wellbeing and their legal rights and entitlements, with reference to PACE;

    7. consult, where appropriate, the detainee's custody record to clarify and check concerns raised by the detainee;

    8. discuss with the custody officer any concerns and requests arising from the custody visit, and to bring to the custody officer's attention any issue that needs to be dealt with;

    9. complete the Independent Custody Visitor Report Form, ensuring that all relevant information is recorded correctly, clearly and concisely;

    10. maintain confidentiality and impartiality in relation to all parties involved in the Independent Custody Visiting process;

    11. make informed judgements in which the community can have confidence and which the police will accept as fair criticism when it is justified;

    12. complete and submit expense claims in line with the Scheme guidelines;

    13. attend continuous training sessions as appropriate (minimum of one each year);

    14. attend as appropriate local panel meetings of Independent Custody Visitors;

    15. carry out the duties of an Independent Custody Visitor with regard to the Health and Safety requirements of the Custody Visiting Scheme;

    16. carry out the duties of an independent Custody Visitor as set out in the Scheme's guidelines;

    17. maintain effective working relationships with police staff as set out in the Scheme's guidelines.

  2. the Lincolnshire Police Authority will

    1. ensure that custody visitors are properly supported in performance of their role;

    2. pay close regard to Force Standing Orders and Home Office/Independent Custody Visiting Association (ICVA) guidelines and best practice;

    3. keep custody visitors informed of developments in Independent Custody Visiting both locally and nationally;

    4. ensure where necessary that any issues/concerns arising from custody visits are dealt with by the Force;

    5. provide a visiting rota and updated contact details on a quarterly basis for each local visiting panel;

    6. provide continuous training sessions as appropriate (minimum of two each year);

    7. provide representative(s) at meetings of panel visitors and/or co-ordinators;

    8. process expense claims in a timely and efficient manner;

    9. have regard to the Scheme's guidelines in respect of the process for dealing with complaints made against custody visitors;

    10. have regard to the Scheme's guidelines in respect of the process for removing custody visitors from the Lincolnshire scheme;
